Whilst we endeavour to keep the information up-to-date and correct, we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk. If you would like specific guidance relating to your own situation, please contact us.
1.2 Except as required by law, we shall not be liable for any direct, indirect or consequential loss, damage or expense of any kind whatsoever including but not limited to loss of production, profits or contracts or losses consequent upon loss or corruption of data as a result of access or failure of access to or use of this website or the downloading of any materials from it.
2 LINKS TO OTHER WEBSITES
2.1 We take no responsibility for the content or operation of third party websites that you may access following links from this website. We have no control over the nature, content and availability of those sites. The inclusion of any links does not necessarily imply a recommendation or endorse the views expressed within them.
2.2 If you would like to link to our website you should apply to us for permission first. We do not allow any third party links to our website without permission.
3 ACCURACY OF INFORMATION ON THIS WEBSITE
3.1 While we have taken every care to ensure the accuracy of information on our website, there may be occasional errors for which we apologise and we draw your attention to our limitation of liability clause above.
4 NO OFFERS OR ADVICE
4.1 Nothing on this website shall be construed as an offer or the basis for a contract between us and you or any other party except as provided in our sales terms and conditions.
4.2 Information on this website is provided for information purposes only, you should not rely on it to make any decision without either taking professional advice or verifying the accuracy of the information provided.
5 COPYRIGHT
5.1 The materials on our website are owned by us and we reserve copyright and all other rights in them. Our name and any image or logo we use to identify ourselves are our trade marks and may not be reproduced without our permission in writing.
5.2 You may not modify, publish, transmit, transfer, sell, reproduce, create derivative works from, distribute, display, or in any way exploit any of the content of musicalchairs, in whole or in part, except as otherwise expressly permitted by musicalchairs.
5.2 You may download or copy the content of this site only for your own personal use, provided that you maintain and include all copyright and other notices contained in such content. You shall not store electronically any portion of the content. Except as expressly permitted by the copyright laws, no copying, storage, redistribution or publication of any content is permitted without the express permission of musicalchairs.
6 ADVERTISING CONTENT, REFUNDS and CANCELLATIONS
6.1 musicalchairs reserves the right to withdraw (without refund) advertising which, in the opinion or musicalchairs, might mislead, harm or offend. Correspondence between Advertiser and Readership subsequent to publication must also meet these standards. Decisions on the withdrawal of advertising are at the total discretion of musicalchairs.
6.2 The contracts for positions of employment advertised on musicalchairs must be fair, transparent and reflect high professional working practices and conditions.
6.3 If the advert is for a position that has arisen as the result of a past or present labour dispute, or if it is in any way contentious (either actually or potentially), then musicalchairs may withdraw (without refund) the advert with immediate effect.
6.4 Except in the case of an annual subscription, a listing fee cannot cover multiple jobs. For instance, "Leader of Second Violins" is one job, but "Leader of Second Violins and Tutti First Violins" are two separate seats and therefore command two distinct listing fees.
6.5 An annual subscription applies to one performing group only, and cannot be used for multiple performing groups, even if they are administered by the same management.
6.6 Musicalchairs may withdraw (without refund) listings for Courses/Masterclasses where it appears that the attendance fee is not commensurate with the services offered. The primary purpose of Courses on our site must be educational, not to raise revenue for the hosts.
6.7 Musicalchairs may withdraw (without refund) listings for Competitions where it appears that the primary purpose is to raise revenue for the organisers. Competitions should have a published and professionally recognised jury. We do not sanction application fees for remote online judging where there is a lack of transparency and integrity of process.
6.8 Once your posting is published live, you have availed of our services and refunds for withdrawn advertising are at the discretion of musicalchairs management. If publication has been deferred, full refund will be given upon cancellation up until the publication date.
6.9 The content of postings may be amended at any stage during the lifetime of the listing as long as the primary subject matter is consistent. Advertisers can not use the shell of an existing posting in order subsequently to list a different job, course, competition or instrument sale.
7 MAINTENANCE
7.1 Every effort is made to keep the website up and running smoothly. However, musicalchairs takes no responsibility for and will not be liable for the website being temporarily unavailable.
8 CHOICE OF LAW
8.1 Our website and these terms and conditions shall be governed by English law and subject to the exclusive jurisdiction of the English Courts.
